By accessing or using HeadshotZen (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

HeadshotZen is an AI-powered headshot generation service that transforms user-uploaded photos into professional headshots. The Service uses artificial intelligence to process and generate images based on your input.

3. Account Registration

• You must sign in using a valid Google account to use the Service.
• You are responsible for maintaining the security of your account.
• You must be at least 18 years old to use the Service.
• You agree to provide accurate information during registration.

4. Credits and Payments

• HeadshotZen operates on a credit-based system. Each headshot generation consumes one credit.
• New users receive 2 free credits upon registration.
• Additional credits can be purchased through our pricing plans.
• All purchases are one-time payments. Paddle.com is our Merchant of Record and handles all payment processing, invoicing, and sales tax on our behalf.
• By making a purchase, you also agree to Paddle's Terms of Use and Privacy Policy.
• Credits do not expire and are non-transferable.
• All prices are displayed in USD. Local currency conversion and applicable taxes are handled by Paddle at checkout.

6. Acceptable Use

You agree not to:

• Upload photos of other people without their consent.
• Use the Service to generate deceptive, fraudulent, or misleading content.
• Upload inappropriate, offensive, or illegal content.
• Attempt to reverse-engineer, hack, or disrupt the Service.
• Use automated tools to access the Service without permission.

7. Intellectual Property

• You retain ownership of the photos you upload.
• You are granted full commercial usage rights to the AI-generated headshots.
• You may use generated headshots for personal and commercial purposes, including LinkedIn profiles, resumes, websites, and social media.
• The HeadshotZen brand, logo, and website design remain our intellectual property.

8. AI-Generated Content Disclaimer

HeadshotZen uses artificial intelligence to generate headshots. While we strive for high quality, results may vary. AI-generated images may not perfectly represent your appearance. We do not guarantee that generated headshots will meet specific requirements for official documents (e.g., passports, visas).

9. Limitation of Liability

HeadshotZen is provided “as is” without warranties of any kind. We shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your account if you violate these Terms. You may delete your account at any time by contacting support@headshotzen.com. Upon termination, unused credits may be refunded in accordance with our Refund Policy.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation. If a resolution cannot be reached, disputes shall be submitted to binding arbitration.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will notify users of significant changes via email or a notice on the website.
